After completion of the sale of Nokia’s Devices & Services business to Microsoft, the new Finnish company Microsoft Mobile Oy assumes responsibility for the personal data of that business’ customers. Nokia customer information that does not relate to the Devices & Services business remains with Nokia. In the case of some services – specifically Nokia Account, the Nokia Improvement Program and the Net Promoter Score – Nokia and Microsoft Mobile will share responsibilities for customer information. The questions and answers below provide further details about what happens after the sale.

1. Question: After Microsoft has acquired Nokia’s Devices & Services business, what changes about the way my personal data is collected and processed?

Answer:
After Microsoft’s acquisition of Nokia’s Devices & Services business, personal data that relates to each of the devices and services covered by that business will be collected and processed by a new Finnish company, Microsoft Mobile Oy.

Apart from the change in ownership, nothing changes in substance in how your personal data is collected and processed. Microsoft Mobile is maintaining Nokia’s privacy policy with minor changes to reflect Microsoft Mobile’s ownership. Microsoft Mobile will collect and use the same types of personal data. The acquisition will not change the purposes for which that data is processed.

2. Question: What are the specific differences between Microsoft Mobile’s privacy policy and Nokia’s previous privacy policy?

Answer:
As explained above, after the acquisition, the privacy policy for the Devices & Services business stays the same in substance, with Microsoft Mobile then responsible for all personal data collected under the policy for that business.

In addition, Microsoft and Nokia have created some new privacy documentation as part of the sale to help you understand what will happen. Specifically, Microsoft and Nokia have developed a new privacy supplement that explains how Nokia Account will be used to access both Microsoft Mobile’s and Nokia’s services. We have also updated the privacy supplement for the Nokia Improvement Program and Net Promoter Score to provide similar additional information. These updated documents are available at here.

We have also updated the privacy policy to clarify that Microsoft abides by the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of data from the European Economic Area and Switzerland.

3. Question: Will Nokia retain any of my personal data from its Devices & Services business following the sale?

Answer:
After the sale, services not related to the Devices & Services business remain with Nokia and Nokia will continue to be responsible for the processing of personal data relating to those services. As explained below, Nokia shares responsibility for personal data with Microsoft Mobile for Nokia Account, the Nokia Improvement Program and the Net Promoter Score. Other than that, Microsoft Mobile assumes responsibility for personal data related to the Devices & Services business.

4. Question: If I understand correctly, Microsoft Mobile’s privacy policy only applies to certain services. How do I know which privacy policy applies to which services after the sale?

Answer:
Microsoft’s purchase of Nokia’s Devices & Services business includes all Lumia, Asha and S40, S30, Symbian and MeeGo-based devices as well as certain former Nokia applications and services related to these devices. Any personal data that is collected in connection with the transferred business, is governed by the Microsoft Mobile privacy policy. You can view this policy at here.

It is important to note that Microsoft is not purchasing all of Nokia’s applications and services. Nokia continues to be responsible for any personal data collected and used in connection with the Nokia applications and services that continue to be owned by Nokia, such as Nokia’s HERE mapping applications.

5. Question: I understand that both Nokia Corporation and Microsoft Mobile Oy share responsibility for personal data for Nokia Account, the Nokia Improvement Program and the Net Promoter Score after the sale. What does this mean in practice?

Answer:
Nokia Corporation and Microsoft Mobile Oy share responsibility for Nokia Account, the Nokia Improvement Program and the Net Promoter Score data. This means that after the sale both companies are responsible for this data and both will be responsive to your privacy needs.
In practice:

  • You can continue to access Nokia services (i.e. the services that Microsoft has not purchased from Nokia, and that Nokia will continue to operate) with your Nokia Account.
  • You can also access services provided by Microsoft Mobile (i.e. the services that Microsoft has purchased from Nokia) with your Nokia Account.
  • If you want to update your profile – for example your email address or phone number or to unsubscribe from receiving newsletters and promotions – you can continue to do that through the Nokia Account profile management tool (available at here).
  • If you want to exercise your privacy rights on Nokia Account, you can contact either Microsoft Mobile or Nokia – whichever you prefer. Either way, your request will be addressed by both Microsoft Mobile and Nokia and acted upon according to the privacy policies applicable to Nokia Account.
  • Collection of data through the Nokia Improvement Program and the Net Promoter Score will work in both Nokia and Microsoft Mobile products and services. Nokia will use the data that is collected from Nokia services and Microsoft Mobile will use data that is collected from Microsoft Mobile services. If you choose to disable the Nokia Improvement Program on your device or application, the Nokia Improvement Program will stop sending your usage data to both Nokia and Microsoft Mobile.

6. Question: On my device and/or application user interface and/or sales box, I still see the word “Nokia.” After the sale, am I still interacting with Nokia, or am I now interacting with Microsoft? Who is receiving my data for each given service?

Answer:
Microsoft is acquiring Nokia’s Devices & Services business, including all Lumia and Asha and S40, S30, Symbian and MeeGo-based devices, as well as certain former Nokia applications and services related to these devices. Once the purchase is complete, updating all of the text in Nokia’s former devices, services and apps, and packaging will take time. We are actively working on these updates. However, at all times after the purchase is complete, including during this transition, these devices, services and applications are governed by Microsoft Mobile’s privacy policy available at here.

However, Nokia’s applications and services (i.e. the applications and services that Microsoft is not purchasing from Nokia) continue to be provided by Nokia, and are governed by Nokia’s privacy policy at: here.

7. Question: I understand there is a new privacy supplement for Nokia Accounts. What does this supplement contain and why did you introduce it?

Answer:
After the sale, Nokia Account can be used to access both Microsoft Mobile’s and Nokia’s services. We created a new privacy supplement to better explain this relationship.

8. Question: I understand you have updated the privacy supplement for the Nokia Improvement Program and the Net Promoter Score. What's changed?

Answer:
The Nokia Improvement Program and the Net Promoter Score have been used to collect product improvement related information across many of Nokia’s products and services. However, due to the sale, the Nokia Improvement Program and the Net Promoter Score will collect related information from both Microsoft Mobile’s and Nokia’s products and services. We updated the existing Nokia Improvement Program privacy supplement accordingly and also included an explanation of the Net Promoter Score in the supplement to better explain this relationship.

9. Question: Does the sale of the Devices & Services business change the countries where my data will now be transferred? After the sale, will Microsoft Mobile transfer my personal data to the United States?

Answer:
There are no changes in where your data may be transferred to. Nokia’s privacy policy already informed users that Nokia’s products and services might be provided using resources and servers located in various countries around the world, including countries outside the European Economic Area (EEA), such as the United States. Some data may be stored in or accessed from locations outside of Europe – but this is not new. As with Nokia Inc., Microsoft Corporation and its controlled subsidiaries in the United States are certified under the U.S.-EU Safe Harbor Framework regarding the collection, use, and retention of data from the EEA. Your personal data will continue to be protected by robust privacy and security measures, regardless of where it is located.

10. Question: If I want to access my personal data, or want it to be corrected or deleted after the sale, how can I do that?

Answer:

11. Question: I want my Nokia Account to be deleted. How can I do that?

Answer:
You may terminate your Nokia Account through “terminate your account” functionality at here.

12. Question: Do I need to update my applications or device software due to these changes?

Answer:
No. You should experience no difference in the functionality of the applications or your device as a result of the sale.

13. Question: I have both a Microsoft Account and a Nokia Account. Will Microsoft combine my personal data across the two accounts?

Answer:
No, your Microsoft Account and Nokia Account remain separate and each is offered by separate Microsoft entities.

14. Question: Will Microsoft share my data with law enforcement agencies who wouldn’t have been able to receive my data from Nokia?

Answer:
Microsoft complies with applicable data protection and other laws, just as Nokia would have to the extent its data processing was covered under any specific jurisdiction’s laws. Consistent with Nokia’s privacy policy that applied to the devices and service business, after the sale Microsoft may be obligated by law to disclose personal data to certain authorities or other third parties, for example, to law enforcement agencies in the countries where we or third parties acting on our behalf operate.
